Dear Ms. Lopez,
Enclosed please find two interim motions, with English translations, filed last week by my German attorney for relief. I have not received a decision on these motions, and I have no idea if I will get one.
It is my firm belief that the German court is in non-compliance of the Hague Treaty, which says that the court must act “expeditiously” to return abducted children to their habitual residence, and within six weeks of the court filing of Dec. 24.
The German judge has no jurisdiction to determine custody or where the children ought to reside. The only jurisdiction she has is to order the return of the children, unless certain exceptions are satisfied. In her own words, the judge stated that Mr. Okyay did not meet these strict exceptions in accordance with the Hague Treaty.
My opinion is that the judge is engaging in delay tactics and favoritism by granting Mr. Okyay every allowance possible, giving him chance after chance to comply with her ruling to return the Okyay children and pay for repatriation. He has repeatedly ignored the court’s rulings and the German court has not held him accountable.
My case is moving to German Appellate Court due to a last minute objection filed by Mr. Okyay. I am literally being held hostage by a rogue judge who is refusing to grant me temporary full custody or to “so order” her own ruling, so that I can obtain American passports for the children and go home.
As I have mentioned previously, the children are in my possession. They have explicitly stated to me that they do not, under any circumstances, want to return to their grandparents home where their father currently resides, and further the children have explicitly stated to me that they want to go home to the USA with me.
I am maintaining all costs in this endeavor, with no financial assistance from Mr. Okyay, despite many requests to do so. Simply put, Mr. Okyay is delaying this case with the hope that I will run out of money and go home without the children.
It is for these reasons set forth above that I make this urgent request that the State Department give me permission to obtain emergency passports for the children and so that these custody issues may be resolved in the competent court of jurisdiction, the 13th Judicial Circuit in Tampa.
We are in the midst of an international crisis. This is an emergency situation. We are American citizens and we need help getting out of this foreign country, as soon as possible. On Friday, Secretary Pompeo urged American citizens living abroad to come home without delay or expect to stay abroad for an extended period of time.
Your time and attention to this urgent matter is greatly appreciated.

I enclose a copy of the invitation to the hearing before the Higher Regional Court in Munich on 22 April 2020.
Furthermore I hand over a copy of the statement of appeal of the lawyer of Mr. Okyay who practically only repeats the same things he has presented in the first instance.
It might be important that you contact the counsel, Ms. Fleschutz, by phone to make an appointment where she can talk to you and especially to the children!
After there is still at least one month to go, you should also contact the Youth Welfare Office and clarify how the livelihood for the children and for you yourself can be clarified until the date of the appointment or until you leave the country.
In the end it would also be an advantage if we can present to the Higher Regional Court how you imagine your return to the States and then the life there!
I can lecture here up to 06.04.2020 at the higher regional court. This means that you answer my office before this date. Personal contact is not allowed because of corona virus.
